Homester Terms of Use

These Terms of Use govern your access to and use of Homester's website, mobile application, web portal, and related services. By creating an account, accessing Homester, or using the service, you agree to these Terms.
If you do not agree to these Terms, do not use Homester.
1. Who We Are
Homester is a household operational continuity service. Homester helps users preserve, retrieve, and maintain practical household information such as property records, asset records, provider information, warranties, receipts, manuals, maintenance history, reminders, photos, screenshots, emails, and related household materials.
Homester is not a legal, financial, insurance, tax, medical, emergency, contractor, or professional advisory service.
2. Eligibility
You must be at least 13 years old to use Homester. If you are under the age of majority where you live, you may use Homester only with involvement and permission from a parent, guardian, or responsible adult.
Homester is not intended for children under 13.
By using Homester, you represent that you are legally able to enter into these Terms.
3. Your Account
You may need to create an account to use Homester. You agree to provide accurate account information and keep it reasonably current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must notify us if you believe your account has been compromised.
We may suspend or restrict access to your account if we believe it has been compromised, used unlawfully, used in violation of these Terms, or used in a way that creates risk to Homester, other users, or the service.
4. Household Data and User Content
You may upload, submit, create, store, or share information through Homester, including documents, images, emails, notes, property information, asset records, provider records, reminders, and other household materials. We refer to this as "User Content."
You retain ownership of your User Content.
You grant Homester a limited license to host, store, process, reproduce, display, analyze, transmit, and otherwise use your User Content as needed to provide, secure, support, maintain, and improve the service.
This license exists only for the purposes described in these Terms and our Privacy Policy.
5. Information You Should Not Upload
Homester is designed for household operational continuity. It is not designed to be a general vault for highly sensitive records.
Unless Homester provides specific features and safeguards for these categories, you should not upload tax returns, medical records, government identification documents, Social Security numbers, bank statements, credit card statements, passwords or security credentials, highly sensitive legal records, or documents containing sensitive personal information unrelated to household operations.
If you choose to upload these materials anyway, you are responsible for that decision. Homester may process and store them under these Terms and our Privacy Policy, but Homester is not designed or intended to serve as a specialized sensitive-record repository.
6. Accuracy of Records
Homester helps organize and retrieve household information, but you are responsible for reviewing records, summaries, reminders, classifications, suggestions, and extracted data.
Homester may contain errors, incomplete information, stale information, duplicate records, incorrect classifications, missing records, or inaccurate AI-generated content.
You should verify important information before relying on it, especially for repairs, warranties, insurance, safety, legal matters, financial decisions, property decisions, or emergency situations.
7. AI, OCR, and Automation
Homester may use OCR, automation, rules, and artificial intelligence to process documents, extract information, classify artifacts, generate summaries, suggest reminders, and support search and retrieval.
AI-generated or automated outputs may be incorrect, incomplete, outdated, or misleading. Homester does not guarantee that AI-generated or automated outputs are accurate.
AI-generated content is provided for convenience and continuity support only. It is not professional advice.
Homester does not use user documents or household records to train AI models unless we ask for separate permission.
8. Property Sharing
Homester may allow you to share a property, household workspace, record, artifact, or related information with other users.
You are responsible for deciding whom to invite and what access to grant.
Depending on their role, invited users may be able to view, add, edit, export, delete, or manage information associated with a shared property or workspace.
Homester is not responsible for actions taken by users you invite or authorize.
9. Acceptable Use
You agree not to use Homester to violate any law or regulation; upload content you do not have the right to use; infringe intellectual property, privacy, publicity, or other rights; upload malware, harmful code, or abusive content; attempt to access accounts, systems, data, or files without authorization; interfere with or disrupt the service; reverse engineer, scrape, crawl, overload, or abuse the service; circumvent security, rate limits, access controls, or usage limits; use Homester to store or distribute unlawful, harmful, exploitative, or abusive material; misrepresent your identity or affiliation; or use Homester for high-risk, emergency, life-safety, or regulated decision-making purposes.
We may remove content, restrict use, suspend accounts, or terminate access if we believe these Terms have been violated or if use of the service creates legal, security, operational, or user-safety risk.
10. Subscriptions, Fees, and Payment
Some Homester features may require a paid subscription.
Subscription terms, prices, billing periods, renewal rules, trial terms, usage limits, and cancellation options will be presented at purchase or in the applicable app store, payment provider, or account settings.
Unless otherwise stated, subscriptions renew automatically until canceled.
You are responsible for applicable taxes and charges.
Payments may be processed by third-party payment providers or app stores. Their terms and policies may also apply.
11. Usage Limits
Homester may apply usage limits, including limits on uploads, storage, processing, AI usage, artifact ingestion, exports, API usage, or other service activity.
We may modify usage limits to maintain service reliability, control costs, prevent abuse, or reflect subscription plan changes.
If a feature is subject to a limit, Homester may reject, delay, throttle, or stop processing activity that exceeds the limit.
12. Exports and Deletion
Homester supports user export and deletion of account and household data, subject to legal, security, backup, billing, and operational requirements.
You may request export or deletion through available account tools or by contacting support@homesterapp.com.
Deletion may not be immediate in all systems. Certain information may remain for a limited period in backups, logs, billing records, fraud-prevention records, security records, or legal records where retention is reasonably necessary or legally required.
13. Third-Party Services and Integrations
Homester may integrate with third-party services such as cloud storage providers, email services, identity providers, payment processors, analytics providers, OCR providers, AI providers, app stores, or support tools.
Your use of third-party services may be governed by their own terms and privacy policies.
Homester is not responsible for third-party services, third-party content, third-party availability, or third-party actions.
14. Service Availability and Changes
Homester may change, suspend, discontinue, limit, or modify features at any time.
We may perform maintenance, update software, change infrastructure, impose limits, or modify functionality.
We do not guarantee that Homester will be uninterrupted, error-free, secure, or available at all times.
15. Beta, Trial, or Preview Features
Homester may offer beta, trial, experimental, or preview features.
These features may be incomplete, unstable, limited, inaccurate, or changed without notice. They may be subject to additional terms or limits.
You should not rely on beta, trial, experimental, or preview features for critical household, safety, legal, financial, insurance, or emergency purposes.
16. Intellectual Property
Homester and its software, design, branding, logos, content, features, documentation, and technology are owned by Homester or its licensors and are protected by intellectual property laws.
Except for the rights expressly granted to you, these Terms do not transfer ownership of Homester intellectual property to you.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Homester except as allowed by law or with our written permission.
17. Feedback
If you provide feedback, suggestions, ideas, bug reports, or feature requests, you grant Homester the right to use them without restriction or compensation.
This does not give Homester ownership of your User Content.
18. Disclaimers
Homester is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Homester disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.
Homester does not guarantee that records will be complete, accurate, or current; documents will be processed correctly; AI or automated outputs will be accurate; reminders will be delivered or received on time; uploaded files will always be retrievable; the service will be uninterrupted or error-free; or the service will meet your specific needs.
You are responsible for maintaining your own backups of important records.
19. No Professional Advice
Homester may help organize information related to household operations, providers, warranties, maintenance, insurance, assets, or property history.
Homester does not provide legal, tax, financial, insurance, real estate, medical, engineering, contractor, safety, or emergency advice.
You should consult qualified professionals before making decisions that require professional judgment.
20. Limitation of Liability
To the fullest extent permitted by law, Homester and its owners, officers, employees, contractors, agents, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, device failure, property damage, or cost of substitute services.
To the fullest extent permitted by law, Homester's total liability for any claim related to the service or these Terms will not exceed the greater of the amount you paid to Homester for the service during the three months before the event giving rise to the claim, or one hundred dollars.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
21. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Homester and its owners, officers, employees, contractors, agents, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of Homester; your User Content; your violation of these Terms; your violation of law; your violation of another person's rights; your sharing of property or household data with other users; or your use of Homester for purposes outside its intended scope.
22. Suspension and Termination
You may stop using Homester at any time.
We may suspend, restrict, or terminate your access if you violate these Terms; your use creates legal, security, operational, or user-safety risk; your account appears compromised; payment is not received for paid services; we are required to do so by law; or we discontinue the service or relevant feature.
Upon termination, your right to access Homester will end. Certain provisions of these Terms will survive termination, including provisions related to ownership, disclaimers, limitation of liability, indemnification, dispute resolution, and data retention.
23. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
24. Dispute Resolution
Before filing a claim, you agree to contact us and try to resolve the dispute informally.

If we cannot resolve the dispute informally, disputes will be handled in the state or federal courts located in Texas, unless applicable law requires a different forum.
You and Homester waive the right to participate in class actions, class arbitrations, or representative actions to the fullest extent permitted by law.
25. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will update the date above and provide additional notice where appropriate.
Your continued use of Homester after updated Terms become effective means you accept the updated Terms.
